What is Aggravated Assault?

Aggravated Assault under section 268(1) of the Criminal Code is an assault (visit our “assault” page for more info) of one person on another, without their consent, and as a result, he or she wounds, maims, disfigures or endangers the life of that person. An aggravated assault is a serious charge that applies to cases where the other person suffered significant injuries or faced a potential risk of death. The four terms, “wounds, maims, disfigures, or endangers the life”, each describe different kinds of injuries. “Wounds” means breaking the skin but does not include minor cuts. “Maims” includes cases where the person caused broken bones that left the other person less capable of defending themselves. “Disfigures” means the person caused serious facial injuries that were long-lasting or permanent. “Endangers the life” means the person caused the other person to face a risk of losing their life.

Punishment for Aggravated Assault

Aggravated assault is a straight indictable offence because of its seriousness and carries lengthy imprisonment sentences. A finding of guilt on an aggravated assault charge can result in a sentence of up to 14 years in prison, resulting in a criminal record. The sentence imposed largely depends on the facts of the case, the injuries inflicted during the assault, and any aggravating factors such as if there is a previous related criminal conviction for an assault or other violent offence.
