Trafficking of firearms is a very serious crime and is aggressively prosecuted by the Public Prosecution Service of Canada. As of 1998, both the Criminal Code and the Firearms Act regulate the possession, acquisition, use and movement of firearms and other weapons. Mandatory minimum penalties apply to a number of firearm offences, including weapons trafficking. A mandatory minimum of imprisonment of four years will apply where a firearm was used to commit criminal negligence causing death, manslaughter, attempted murder, causing bodily harm with intent, sexual assault with a weapon, aggravated sexual assault, kidnapping, robbery, extortion and hostage-taking. What is Trafficking of Firearms?
Under section 99 of the Criminal Code, to traffic a firearm is where a person manufactures, transfers, or offers to manufacture or transfer, a firearm, without authorization under the relevant law. By “transfer”, the law criminalizes any sort of transactions of a firearm done without legal authorization. This includes selling, distributing, and even lending a firearm to another person. Trafficking firearm offences do not require that a person receive or provide a benefit (such as money) to another for the weapons. So long as there is a transferred firearm from one person to another, and the transferring person knows that the transaction was not authorized by law, they could be found guilty of trafficking a firearm. The law also criminalizes possession of a firearm for purposes of trafficking, and the illegal import and export of firearms.
Punishment for Trafficking Firearms
Trafficking of a firearm is an indictable offence and carries serious minimum imprisonment sentences. For the first offence, the sentence imposed carries a minimum of at least three years in prison. For second and subsequent convictions, the minimum jail sentence is of five years, which must be served at a penitentiary. In any other cases, the sentence cannot exceed ten years of imprisonment, per criminal charge, and to a minimum punishment of one year of imprisonment. In addition, upon finding of guilt, you will also be subject to a mandatory weapons prohibition.
