What is Attempted Murder?
Under section 24 of the Criminal Code, an “attempt” is defined as everyone who, having an intent to commit an offence, does or omits to do anything for the purpose of carrying out the intention. Attempted murder, then, is someone who has intent to commit murder and engages in actions for the purpose of carrying out murder. There mere thought of committing murder is not enough. The person must have actively tried to carry out their plan. The Criminal Code does not describe specific actions that would constitute attempted murder. Instead, the Courts will look at all the evidence in the case, including factors such as the presence of a motive and purchase and possession of a weapon, to determine whether the accused attempted to commit murder. In addition, the Crown must prove beyond a reasonable doubt that at the time of the offence, the accused had specific intent to kill another person.
Punishment for Attempted Murder
Attempted murder is a very serious offence in Canada. A conviction on an attempted murder charge carries a maximum sentence of life in prison. If the offence is committed using a restricted or prohibited firearm in connection with organized crime, a minimum sentence of five years in prison will be imposed in case of a first offence and if committed with any other type of firearm, there is a minimum sentence of four years in prison. In all other cases, there is no minimum punishment but the maximum sentence of imprisonment for life applies.
