Alcohol impaired driving is one of the leading causes of death in Ontario. Impaired driving means to operate a vehicle, including cars, trucks, boats, snowmobiles and off-road vehicles, while your ability to do so has been compromised to any degree by consuming alcohol, drugs or a combination of the two. The police have the power to stop drivers to check to ensure that the drivers have a valid licence, if they are sober and if their vehicle is roadworthy. You can be charged with impaired driving even if you blood alcohol concentration (“BAC”) is under the maximum legal limit, being 80 milligrams of alcohol in 100 milliliters of blood. Your abilities to operate a vehicle can be impaired by illegal drugs, over-the-counter and prescription medications, cannabis, and alcohol. What is Impaired Driving?

Impaired driving is one of several offences in the criminal code that relate to drinking and driving, the other most common being “at or over 80” (visit our “at or over 80” page for more info) and refusing to provide a breath sample. It is important to note that even if police don’t ask you to provide a breath sample, you could still be charged and found guilty of impaired driving. This is because impaired driving does not require that you “blow at or over,” since impairment refers only to your ability to drive and not your BAC. Police use a variety of tests to detect impaired drivers, such as carrying out a roadside standardized field sobriety test, by demanding a breath sample, and if the officer has reasonable grounds to believe that a driver is impaired, a drug recognition evaluation will be carried out by a qualified officer at the police station. It is important to note that even if you are not driving but are sitting in the driver’s seat of a parked vehicle while your abilities are impaired, you could still be charged and potentially convicted for “care and control while impaired” (visit our “care and control” page for more info).

Punishment for Impaired Driving

When you are charged with impaired driving, you will be subject to an automatic 90-day administrative driver’s license suspension, a seven-day impoundment of your vehicle with costly towing and impounding fees, $550 penalty fee, and $275 licence reinstatement fee.
If you are found guilty of impaired driving at trial, you would also face a mandatory minimum fine of $1000.00, as well as a 1-year license suspension if this is your first offence, followed by at least another year during which you can only drive in a vehicle equipped with an interlock device, which are costly to install and maintain, as well as increase in insurance cost. If there was an accident where someone got injured, or if this was not your first drinking and driving offence, those penalties increase significantly. If you are prosecuted by indictment and convicted of impaired driving, you may be liable to imprisonment not exceeding 5 years. If you are prosecuted by indictment and convicted of impaired driving causing bodily harm, you may be liable to imprisonment not exceeding 10 years.
